Exclusion of Liability, Waiver of Claims, and Assumption of Risks Agreement

Tait Heritage Farms Ltd.

PLEASE READ CAREFULLY. BY SIGNING THIS DOCUMENT, YOU ARE WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.

 

1. Acknowledgement of Inherent Risks

I understand and acknowledge that participation in events, gatherings, and activities at Tait Heritage Farms Ltd., located in Sussex, New Brunswick, involves certain risks, hazards, and dangers, including but not limited to:

  • Uneven ground, natural terrain, holes, fences, gates, water features (including ponds), rocks, mud, and slippery or unstable surfaces.

  • Interaction with or proximity to farm animals, domestic pets, livestock, and wildlife, which may behave unpredictably.

  • Participation in activities such as but not limited to food tasting, consumption of food and beverages (including potential allergens), dancing, live music, painting, workshops, tours, hayrides, demonstrations, and other recreational or educational activities.

  • Outdoor weather conditions including sun, rain, wind, storms, heat, and cold.

  • Use of or proximity to farm equipment, buildings, fences, and vehicles.

  • The possibility of personal injury, illness, food-borne illness, allergic reaction, emotional stress, property damage, or death.

I freely accept and fully assume all such risks, dangers, and hazards, whether or not described above, and the possibility of personal injury, illness, property damage, or death resulting therefrom.

 

2. Release of Liability and Waiver of Claims

In consideration of being permitted to attend or participate in events, gatherings, or activities hosted by Tait Heritage Farms Ltd., I hereby agree as follows:

  • To waive any and all claims that I may now or in the future have against Tait Heritage Farms Ltd., its directors, officers, employees, volunteers, agents, contractors, event partners, and sponsors (collectively, the “Released Parties”) arising out of my participation.

  • To release the Released Parties from any and all liability for any loss, damage, expense, or injury including death that I may suffer, or that my next of kin may suffer, resulting from participation in these activities, due to any cause whatsoever, including negligence, breach of contract, or breach of any statutory or other duty of care.

  • That this agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns, and representatives.

3. Assumption of Responsibility

I accept full responsibility for my own actions and safety, and I agree to:

  • Follow all posted rules, instructions, and directions from staff, volunteers, or event leaders.

  • Supervise and remain responsible for any minors or dependents under my care.

  • Refrain from engaging in any activity that may cause harm to myself, others, animals, or property.

  • Inform organizers of any allergies, dietary restrictions, or health concerns that may affect my participation.

4. Medical Consent

In the event of illness, injury, or medical emergency, I consent to receive first aid, emergency medical care, or transport at my own expense, as deemed appropriate by event staff or medical personnel.

 

5. Photography & Media Release

I grant permission to Tait Heritage Farms Ltd. to use photographs, videos, or other media taken during events that may include my image or likeness, for promotional, educational, or commercial purposes, without compensation.

 

6. General Provisions

  • This waiver shall be governed by the laws of the Province of New Brunswick and the laws of Canada applicable therein.

  • If any portion of this agreement is deemed invalid, the remainder shall remain in full force and effect.

  • I confirm that I am of legal age (or the parent/guardian of a participating minor) and that I have read and understood this agreement prior to signing.
